Supplemental Affidavit of David S. Wean in Support of Injunctive Relief
I, David S. Wean, do hereby affirm and attest as follows:
My name is David S. Wean and I live at 19 Congreve St. in Roslindale, Massachusetts.
- I provide this affidavit as a supplement to the affidavit I have already prepared regarding obstructions
commonly blocking the lane of travel of the Southwest Corridor Bicycle Path caused by the Metropolitan District Commission [MDC], the entity responsible for maintaining the bicycle roadway.
- For the past month or so, the Southwest Corridor Bicycle Path has been blocked daily by the fencing contractor
hired to doing work near the path. The fencing company, which I believe is called Cosco, presently is working at several spots along the path.
- Trucks and related construction vehicles belonging to this fencing company have been blocking the lane of travel
on the bicycle path daily for over a month now.
- On a Thursday morning, October 21,1999, I asked one of the workers if he could move his truck over so it wouldn’t block the bicycle path. He told me he’d been instructed to keep the truck’s tires "off the grass".
- Apparently not harming the grass is more important than maintaining an unobstructed lane of travel for the
bicycle path.
